It depends if it happened in a no-fault state. In most states your insurance will pay for the damages and they will go after the other driver. Good luck.

Check your insurance policy. Many times there is a rider clause that will cover uninsured motorists. If you have it in place, you can file the claim through your own insurer. Your insurance company, in turn, will attempt to collect from the other driver. If you don’t have the uninsured motorists clause, you most likely will have to seek recourse through the courts. But, this will take time so patience is needed.
